A sample agreement to be used when a producer or production company is commissioned to produce a video program for purposes such as promotion, education or instruction. Because of the diversity of production agreements, it is important that the parties carefully consider all aspects of the agreement before signing. In particular, they should pay close attention to questions of copyright and ownership of materials produced under the agreement.
The agreement covers only the relationship between the producer and the commissioning client. It does not relate to any of the other people who are usually involved in the production of a low budget film or video, such as the director, writer of the screenplay, composers of the soundtrack or performers. Generally, it is the responsibility of the producer to enter into agreements with these parties.
The sample agreement is drafted on the premise that it is a video rather than a film that is being produced. If it is a film, amend the agreement accordingly.
