June competitions checked by Arts Law
Arts Law has checked the terms and conditions of 14 competitions closing in June 2014.
5 competitions received an outstanding 5/5 stars for fairness to artists!
· 2014 IPAF ATOM Awards – deadline 6 June 2014
· Melbourne Prize for Urban Sculpture 2014 – deadline 16 June 2014
· Archibald Prize 2014 – deadline 27 June 2014
· Wynne Prize 2014 –deadline 27 June 2014
· Sir John Sulman Prize 2014 – deadline 27 June 2014
The organisers of all of these competitions worked in consultation with Arts Law to ensure their terms relating to copyright licensing and moral rights were fairer for artists. These competitions acknowledge that copyright remains with the artist, make a positive undertaking to attribute the entrants and narrowly limit the licence to reproductions for the purposes of promoting the competition only.

ATOM Awards gets 5/5 stars for fairness to artists!
Urban Sculpture competition gets top marks
2 competitions were awarded 4/5 stars for fairness to artists.These competitions only ask shortlisted or exhibited entrants for a licence to reproduce the work for limited purposes associated with the promotion of the competition. A clear limitation of the duration of the licences and a positive intention to attribute the artists would have given these prizes a perfect 5/5 stars.
WELL DONE:
· Noosa Art Award 2013 – deadline 15 June 2014
· Gold Coast International Ceramic Art Award – deadline 27 June 2014
3 competitions received a commendable 3/5 stars for fairness.
Under these terms and conditions, all entrants are asked to provide a licence to the competition organisers to reproduce their works for purposes associated with the competition. None of the competitions set a limit to the duration of the licences requested from the entrants. If these competitions had done so, and respectively limited their licences to finalists or winners, plus each undertook to attribute the artists, they would have all received 5 / 5 stars.
NOT FAR OFF:
· d’Arcy Doyle Art Awards – deadline 2 June 2014
· Eumundi Sculpture Prize 2014 – deadline 27 June 2014
· Macquarie Photography Prize – deadline 30 June 2014
4 competitions scored 2 /5 stars for fairness to artists. These competitions asks that all entrants grant to the competition organisers a licence to reproduce the entries for broad purposes beyond the scope of promotion for the competition. Best practice would be for these licences to be limited to finalists/exhibitors, limited in uses, limited in duration and create a positive intention to attribute the artists.
