Guide to Purchasing Arts Law Sample Agreements

 

Which agreement should you purchase?
Arts Law Sample Agreements are designed to cover a variety of common relationships in different arts sectors. They include the most common terms which the parties to a given relationship, for example a visual artist and a gallery, or a film producer and director, need to consider and agree to.
The series of Sample Agreements is not meant to be exhaustive, and Arts Law does not warrant that it has a Sample Agreement to cover your needs. If you are unsure whether a Sample Agreement is appropriate for your purpose or whether Arts Law has a Sample Agreement to cover your needs, you can contact Arts Law for advice.
Sample Agreements are composed of two parts:
·         An information part for reference. This part provides general information on the Sample Agreement, including how to use it, as well as explanatory notes which explain some of the law governing the relationship and the meaning of the individual clauses of the Sample Agreement; and
·         The Sample Agreement itself, which you must complete any Sample Agreement with the missing information, and might need to change the document to meet your specific circumstances.
You must have your draft agreement reviewed if you have made material changes to the Sample Agreement, i.e. if you have changed the meaning of any clause. Arts Law is not responsible for any loss suffered as a result of any change to the wording of the sample agreement. To the extent permitted by law, Arts Law excludes any liability, including any liability for negligence, for any loss, including indirect or consequential damages arising from or in relation to of any change to the wording of the sample agreement.
Which version should you purchase?
Arts Law’s Sample Agreements are available in 3 different types to suit your needs and your situation as a user of any of those documents.
  1. PDF version, non-editable.

The Sample Agreement is in PDF format and cannot be cut and pasted or edited. You need to type up the main part of the agreement and complete all the details. You do not need to type the instructions and explanatory notes as these are for your information only and do not form part of the sample Agreement.
  1. Word version, editable (Subject to availability) 

The Sample Agreement in editable Word format allows you to create a new document by saving the document you purchase on your computer. Sample Agreements are formatted in such a manner that the numbering of clauses will be automatically updated if you insert new clauses or delete existing ones, for instance where you are requested to choose between two alternative clauses. The cross-referencing will also be updated.
This version is more expensive than the PDF version because you do not have to type the text of the Sample Agreement if you purchase it.
You are responsible for having your draft agreement reviewed if you have made material changes to the Sample Agreement, i.e. if you have changed the meaning of any clause.
  1. Word-version, editable, for legal professionals (Subject to availability)

If you are a legal professional and intend to use the Sample Agreement for your legal practice, you are required to purchase this version. The comments above regarding the Word version, editable, apply similarly to this version. Unlike versions 1 and 2, which are intended for non legal professionals and are subject to a single use licence, legal professionals obtain a multiple use licence when purchasing version 3.

1.      If you are paying by cheque or money order:


(a)           Download the order form from the Shopping Cart print it off and send it to Arts Law with the cheque or money order. Postage and handling fees will apply.

(b) Once your payment has been processed successfully you will receive an invoice via e-mail, which contains a link to the Sample Agreement you have purchased.


(c)           Arts Law cannot process your order if you have not ticked the box to confirm that you agree to the Terms and Conditions for the Use of Documents of the Arts Law Centre of Australia at the end of the order form.


2.      If you are paying by credit card:


(a)           Add the Sample Agreement you wish to purchase your Shopping cart. To add a Sample Agreement to the Shopping Cart you must first go to the information page of the Sample Contract you want to purchase and click on the “+ Add To Shopping Cart” button.


(b)           Complete the Shopping Cart form by ticking the box for the publications listed, adding in your details and process, as well as the “I agree to the Terms and Conditions for the Use of Documents of the Arts Law Centre of Australia.


(c)           Once your credit card has been processed successfully you will receive an invoice via e-mail, which contains a link to the Sample Agreement you have purchased.
