Arts Law checks the terms of competitions closing in April 2014
Arts Law has checked the terms and conditions of 11 competitions closing in April 2014.
2 competitions were awarded 4/5 stars for fairness to artists. The Bay of Fires Art Prize only asks exhibited entrants for a licence to reproduce their work for limited purposes associated with the promotion of the competition. A clear limitation of the duration of the licences and a positive intention to attribute the artists would have given this competition 5/5 stars. The Picturing the World Family photography competition also only asks for a licence from exhibited entrants and makes a positive undertaking to attribute successful prize winning artists which is fantastic!
WELL DONE:

3 competitions received a positive 3.5/5 stars. Although we don’t usually give half stars, these competitions all deserved more than 3 stars for making a positive undertaking to attribute the artists. The Sunshine Coast Art Prize and the Returned to Glory Recycled Art Competition ask all entrants to provide a licence to reproduce their artwork for publicity associated with the competition only. An additional star and a half would have been obtained if the licence had been limited to finalists only and limited in duration. The Biblio Art Award also makes a positive undertaking to attribute the artists which is great however, it is unclear whether the organisers have sought the consent of the original authors of the books which entrants are required to incorporate into their artwork. We would encourage entrants to contact the organisers of the competition to clarify this issue.

- Biblio Art Award – deadline 30 April 2014
5 competitions received a commendable 3/5 stars for fairness. Under these terms and conditions, all entrants are asked to provide a licence to the competition organisers to reproduce their works for purposes associated with the competition. None of the competitions set a limit to the duration of the licences requested from the entrants. If these competitions had done so, and respectively limited their licences to finalists or winners, plus each undertook to attribute the artists, they would have all received 5 / 5 stars.

- The Great Southern Portrait Prize 2014 – deadline 9 April 2014
- City of Wanneroo Art Awards – deadline 17 April 2014
- Chippendale New World Art Prize – deadline 18 April 2014
- City of Melville Art Awards 2014 – deadline 24 April 2014
1 competition scored 2 /5 stars for fairness to artists. This competition asks that all entrants grant to the competition organisers a licence to reproduce the entries for broad purposes and requires entrants to give permission for their work to be adapted. Best practice would be for these licences to be limited to finalists/exhibitors, limited in uses, limited in duration and create a positive intention to attribute the artists.
