Art Centre and Art Gallery Umbrella Consignment Agreement (Artists in the Black)

This sample ART CENTRE AND ART GALLERY UMBRELLA CONSIGNMENT AGREEMENT should be used when an Indigenous Art Centre (Art Centre) provides works of art (Artwork) on consignment to a third party gallery (Gallery) for exhibition and sale.

Under this sample agreement an Art Centre enters into an arrangement with a Gallery:

  • for the sale of Artwork created by its member artists;
  • which comprise one or more shipments of artworks over a period of time;
  • on commission;
  • either for specific exhibitions during that time or more general sales.

Importantly, this sample agreement is an ’umbrella’ agreement designed for an ongoing relationship between the Art Centre and Gallery covering various consignments. The significance of a single agreement covering various shipments is so that the Art Centre need only register one agreement on the Personal Property Securities Register in order to protect itself and its artists. This sample agreement assumes that the Art Centre is a signatory to the Indigenous Australian Art Commercial Code of Conduct (the Code) and that this agreement must comply with the Code.
